Community order for assault

MAGISTRATES gave a 12 month community order to a man after he pleaded guilty to charges of criminal damage and assault at Haverfordwest Law Courts on Wednesday (Jan 7). Trevor Lynam, aged 36, of Dimond Street, pleaded guilty on October 20, 2014 and the case was adjourned from December 3 for a pre-sentence report to be prepared. Prosecuting, Peter Lloyd said: “There had been a breakdown in the relationship between the defendant and the complainant.
“At 9am on October 17, he attended at his partners address and he rang her on her mobile phone to let her know that he was outside. “She became fearful for her safety because of what had happened in the past. “He told her that he had left something inside her house but when she refused to let him in he picked up a shovel and hit the window. “The police were called and the defendant ran away. “At 2:10am the following morning, this woman noticed that the defendant had gained access to her flat through the broken window.
“She asked him what he was doing there and he replied saying he had nowhere to go. “He started accusing her of having an affair and she tried to call the police without him noticing and the 999 call was operated. The operator began to shout and he realised a call had been made. “Lynam then went for her but she got a piece of wood and held it between them to restrain him.
“She has then pushed him off but he then hit her with the piece of wood and pulled her by the hair before punching her to the back of her head. “She managed to get away and call the police. The woman suffered soreness to the back of her head and also had a cut lip. “An officer attended the area and saw the defendant and arrested him pursuing the complaint that had been made”.
Defending, Matt Greenish said: “Since this incident, the parties have reconciled. Lynam feels that the curfew has done more harm than good and that it is too restrictive”. Magistrates gave Lynam a 12 month community order with supervision and an alcohol activity requirement. They also placed him under a six-week curfew between the hours of 7pm and 7am. Lynam will also have to pay £100 in compensation for the smashed window and £50 compensation to the victim, as well as a victim surcharge of £60 and £85 in court costs. There was no separate penalty given for the criminal damage charge.

Bid to build 12 houses near Pembrokeshire school

PLANS for a housing scheme of 12 homes near a Pembrokeshire village school, which includes an affordable housing contribution of £30,000 and a new school footpath, have been submitted.
In an application to Pembrokeshire County Council, Haverfordwest-based Carew Castle Estates, through agent Harries Planning Design Management seeks permission for a housing development of 12 three-bed homes on land south of Sageston County Primary School, Sageston.
The application site comprises of the old school paddock in the centre of Sageston.
A supporting statement says: “This application seeks full approval for 12 detached residential units, with an adoptable access road off the highway. The proposed dwelling mix will comprise four house types, all with three bedrooms, with house type A providing slightly smaller units and house type D providing a one-and-a half-storey dwelling.”
It says an expected five per cent contribution to affordable housing would be met through a commuted sum of £30,519, secured by a Section 106 legal agreement.
It adds: “The proposal also includes a school footpath, with the land gifted to the school. The footpath will allow access to the school and will be controlled by electronic gates. This footpath has been designed in communication with the school governors to ensure that is required.
“We believe this footpath will provide positive community benefits and will ensure that the existing footpaths in the area link directly to the school. The footpath will be bound with anti-climb fencing and significant evergreen hedging to provide ample screening between the dwellings and the path. The footpath will be constructed by the school.”
It concludes: “This proposal is considered to offer an acceptable form of residential development in line with the local development policies. The proposal is respectful of its context and offers a range of tenure options for the market.”
The scheme will be considered by county planners at a later date.
